These Terms and Conditions govern the use of the Portal Lusitano website (hereinafter "Portal" or "Platform"), a digital platform for marketplace, editorial content and tools dedicated to the Lusitano breed. By accessing and using the Portal, the user declares to have read, understood and accepted these terms in their entirety. If you do not agree with any of the terms, you should refrain from using the Portal.
Portal Lusitano provides the following services:
The publication of horse sale listings is subject to payment of a fee, according to the available plans (Basic, Standard, Featured and Premium). Portal Lusitano acts as an intermediary and is not a party to transactions between sellers and buyers. The Portal reserves the right to refuse or remove listings that violate these terms, contain false or misleading information, or do not meet the platform's quality standards.
A seller publishing a listing on the Portal undertakes to: provide true and complete information about the horse, including verifiable genealogical records; be the legitimate owner of the horse or their authorized representative; keep the listing data up to date during the publication period; comply with all legislation applicable to the sale of animals in Portugal, including veterinary and tax regulations.
All payments are processed securely through the Stripe platform, PCI DSS certified. Portal Lusitano is VAT-exempt under Article 53 of the Portuguese VAT Code (CIVA), therefore prices shown do not include VAT. After listing publication, no refunds are granted, except in cases of technical error by the platform that prevents listing publication. Professional subscription payments are recurring and can be cancelled at any time, taking effect at the end of the current billing period.
All content on Portal Lusitano — including texts, photographs, design, logos, source code, databases and editorial structure — is the exclusive property of Portal Lusitano or its duly identified partners and collaborators, and is protected by Portuguese and European copyright and intellectual property legislation. Reproduction, distribution or commercial use of any content without prior written authorization is prohibited.
By submitting content to the Portal (photographs, horse descriptions, comments), the user grants Portal Lusitano a non-exclusive, free and worldwide license to use that content for the purpose of providing the platform's services. The user warrants that they hold the necessary rights over the submitted content and that it does not infringe third-party rights.
Portal Lusitano will make every effort to ensure the accuracy of published information, but is not responsible for: inaccuracies in information provided by third parties (sellers, stud farms, professionals); the outcome of transactions between users; temporary service unavailability due to technical or maintenance reasons; indirect damages resulting from use of the Portal.
These Terms and Conditions are governed by Portuguese law. For the resolution of any disputes arising from the use of the Portal, the courts of Lisbon shall have jurisdiction, with express waiver of any other. In accordance with EU Regulation 524/2013, we inform you that the European Commission provides an online dispute resolution platform, accessible at https://ec.europa.eu/consumers/odr.
In case of complaint, the user may contact us at portal.lusitano2023@gmail.com. Under Decree-Law No. 199/2015, we provide access to the Electronic Complaints Book at www.livroreclamacoes.pt.
Portal Lusitano reserves the right to amend these Terms and Conditions at any time. Changes will be published on this page with the respective update date. Continued use of the Portal after publication of changes constitutes acceptance of the new terms.
